Before And After The Repeal Of The Domestic Dissemination Ban
For over sixty years, the Smith-Mundt Act prohibited the U.S. Department of State and the Broadcasting Board of Governors (BBG) from disseminating government-produced programming within the United States over fears that these agencies would “propagandize” the American people. However, in 2013, Congress abolished the domestic dissemination ban, which has led to a heated debate about the role of the federal government in free public discourse. Although the 2013 repeal of the domestic dissemination ban promotes greater government transparency and may help counter anti-American sentiment at home, it also gives the federal government great power to covertly influence public opinion. To curb the potential harm of surreptitious government propaganda, while also preserving the benefits of repeal, this Note advocates for requiring the State Department and the BBG to clearly attribute any government-produced programming these agencies disseminate within the United States. This Note contends that attribution can be best accomplished in one of two ways: by passing new attribution legislation similar to that of the failed Truth in Broadcasting Act of 2005 or by expanding the judicially created government speech doctrine to require these agencies to properly attribute any materials they distribute to the American public.

The Long March Through The Institutions
I spend an enormous amount of time trying to understand the chaos we’re living through. Not the headlines. The machine behind them. Expensive houses. Expensive schools. Expensive healthcare. Taxes that rise every year while everything gets worse. Borders nobody voted to open. Speech rules nobody voted for. Most people look at this and blame capitalism. The market failed, they say, so the state has to step in and fix it. They have it exactly backwards. What they want to fix it with is what broke it. This isn’t chaos, and it isn’t capitalism. It has a direction, a method, and a hundred-year history. Let me reverse-engineer it. In 1926, Mussolini’s regime threw Antonio Gramsci, co-founder of the Italian Communist Party, into prison. From his cell he asked the question that would shape the next century: why did the revolution win in Russia but fail in the West, where Marx said it was inevitable? His answer: in Russia, the state was everything, so seizing it was enough. In the West, the state was only the outer wall. Behind it stood the real fortress: the church, the family, the school, the press, the culture. Western workers never revolted because the culture held them. So the conclusion was simple. Don’t storm the palace. Capture the culture. Win the institutions and you never have to win the argument, because you decide which arguments are allowed. In 1967, the German student leader Rudi Dutschke gave it a slogan: the long march through the institutions. Paris supplied the intellectual software, and I’ve already apologized for my country’s part in that. Then came the most patient operation in modern history. The students of the 60s became the professors of the 80s. Their students became the journalists, judges, civil servants and HR directors of the 2000s. Their students now run the foundations, the NGOs and the agencies. No single step looked like a revolution. That’s exactly why it worked. The method was communist. The ambition became global. And it grew like a cancer. A cancer never attacks the body head-on. It hijacks the body’s own cells and feeds on the body’s own resources. This system never had to defeat the West. It just had to make the West pay for it.

Lifting Of US Propaganda Ban Gives New Meaning To Old Song
Though its ostensible purpose is to fund the U.S. military over a one year period, the National Defense Authorization Act, better known as the NDAA, has had numerous provisions tucked into it over the years that have targeted American civil liberties. The most well-known of these include allowing the government to wiretap American citizens without a warrant and, even more disturbingly, indefinitely imprison an American citizen without charge in the name of “national security.” One of the lesser-known provisions that have snuck their way into the NDAA over the years was a small piece of legislation tacked onto the NDAA for fiscal year 2013, signed into law in that same year by then-President Barack Obama. Named “The Smith-Mundt Modernization Act of 2012,” it completely lifted the long-existing ban on the domestic dissemination of U.S. government-produced propaganda. For decades, the U.S. government had been allowed to produce and disseminate propaganda abroad in order to drum up support for its foreign wars but had been banned from distributing it domestically after the passage of the Smith-Mundt Act of 1948. However, the Modernization Act’s co-authors, Reps. Mac Thornberry (R-TX) and Adam Smith (D-WA, no relation to the Smith of the 1948 act), asserted that removing the domestic ban was necessary in order to combat “al-Qaeda’s and other violent extremists’ influence among populations.”

The Intruder
There is a species of ant that approaches the edge of another colony, kills a single worker, and then takes on the dead ant’s scent. For ants, scent is everything. Wearing that scent, the intruder walks in with no resistance. The workers pass by without concern. The intruder moves inward, toward the queen, then it sprays the queen with a different scent that makes the workers turn on her. Then they surround her and kill her. The intruder does not need to fight anyone. The colony does the work itself. Once the queen is gone, the intruder reproduces. The true invader is no longer an intruder. It is the future. This is how ideological takeover works. A destructive foreign ideology takes the scent of familiar ideas and walks in as if it belongs. It speaks the native vocabulary, justice, equality, compassion, rights, progress. It uses these words and quietly changes what they point to. Then it moves inward. It alters how foundations are perceived. Responsibility is made to smell like cruelty, law like oppression, borders like hatred, tradition like danger, history like guilt. At that point, the civilization turns on itself. Its courts, universities, churches, media, and bureaucracies begin treating their own foundations as threats. They believe they are defending the system. They are enforcing what now smells legitimate. They do not see the intruder because it sounds exactly like them. And when the founding principles are finally removed, discredited, dismantled, erased, the foreign ideology does not need to conquer anything. It inherits what is left. The queen is gone. The colony is no longer itself. The most effective conquest is the one that convinces a society that its own foundations are the enemy, and that killing them is an act of virtue.
